Terms, Conditions, and Policies for PixelTaken by JOIN.TO.IT LLC

1. Acceptance of Terms

By accessing or using the PixelTaken application (“Application”) developed by JOIN.TO.IT LLC (“we,” “us,” “our”), you agree to be bound by these terms and conditions (“Terms”). If you disagree with any part of the terms, you may not access the Application.

2. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will endeavor to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

3. Use of the Application

  • Eligibility: You must be at least 13 years old to use the Application. By agreeing to these Terms, you represent and warrant that you are at least 13 years old.
  • License to Use: Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to use and access the Application for your personal, non-commercial use.
  • Prohibited Uses: You may not use the Application for any unlawful purpose or to solicit others to perform or participate in any unlawful acts.

4. Intellectual Property Rights

The Application and its original content, features, and functionality are and will remain the exclusive property of JOIN.TO.IT LLC and its licensors.

5. User Content

You retain any and all of your rights to any content you submit, post, or display on or through the Application and you are responsible for protecting those rights. By posting content, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Application.

6. Privacy Policy

Our Privacy Policy, which describes how we handle information collected and received from you, is part of these Terms.

7. Disclaimer

The Application is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties and conditions of any kind, whether express or implied.

8. Limitation of Liability

In no event shall JOIN.TO.IT LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Application.

9. Indemnification

You agree to defend, indemnify, and hold harmless JOIN.TO.IT LLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions.
